-ACCEPTANCE OF THE GENERAL TERMS

1. ACCEPTANCE OF THE GENERAL TERMS – The use of the PhD Hub platform of the European University Foundation (“EUF”), is subject to the Terms of this legal agreement between you and the EUF. The present document contains the agreement and explains its terms of use. These Terms are referred to as “Terms and Conditions”. Next to these Terms and Conditions, you are bound by the Privacy Policy rules of the PhD Hub platform.

2. Before registering on the PhD Hub platform as a User in order to use its Services or when only using/visiting it you must read this document and agree to the Terms and Conditions and Privacy Policy.

3. The data controller reserves the right to change the Terms and Conditions and Privacy Policy and will inform you about the changes by the means of a notice available on the Platform prior to the change becoming effective, yet we encourage you to review them regularly.

4. Specific application to academic staff member (HEI): Indication of false information with regards to Institutional as well as personal data will lead to termination of the Account. In case of change of any information in the HEI data, the contributor (Local PhD Hub Coordinator) takes the responsibility to inform the EUF about such changes and the EUF reserves the right to request the confirmation of the position held at the HEI on a regular basis to guarantee that other users’ data is not exposed to unauthorised persons or third parties.

-ACCESS TO THE PLATFORM

Academic Staff Members (ASM):

The Local PhD Hub Coordinator (an ASM) sets up local PhD Hub and gives access to other local Academic Staff Members, with privileges related to their role. The ASM is also able to invite the contact person of an Enterprise to set up a profile and is also responsible for inviting their PhD students to the platform to set up their profile. ASMs are able to search for students, academic partners and enterprises and open calls for cooperation.

PhD Students

PhD Students set up their profile when receiving the invitation link from the local PhD Hub and are able to display and update their research, portfolio and publications, as well as search for research partners, consult calls for cooperation from enterprises/institutions and fellow PhD students, and open calls for cooperation.

Enterprises/Institutions

Enterprises/Institutions, upon invitation by the respective local PhD Hub Coordinator, are able to set up their profile, outlining their activities and interests.

Enterprises/Institutions are able to search for research partners, open and consult calls for cooperation, and browse PhD student profiles.

PhD seeking students/end user

Any user is able to set up a profile and search for PhD positions available on the Platform.

-APPROPRIATE USE

The data shared on the Platform shall not contain any material and/or statement which violates or infringes in any way upon the rights of others, which is unlawful, offensive or invasive of privacy or publicity rights, gives rise to civil liability or otherwise violates any applicable law. We reserve the right to remove any information that is deemed inappropriate and failing to comply with these Terms and Conditions.

The EUF will not be liable for loss, damage or personal injury to any contributor nor to property or else caused or suffered in connection with this PhD Hub Platform or any information gathered herein.

Third parties may link to the Platform and they will only be hosting, processing or collecting information on behalf of the Data Controller in the context of the Platform to provide you with Services agreed in this document and in the Privacy Policy and adequate technical and organisational measures are in place to ensure confidentiality and security of your information.

-LIABILITY

The EUF will not be liable for loss, damage or personal injury to any contributor nor to property or else caused or suffered in connection with this PhD Hub platform or any information gathered herein.

-OWNERSHIP OF MATERIAL

By submitting text or other material, you represent and warrant that you are the sole authors and holders, or licensees of the material submitted and that they do not violate any copyright, right of privacy, image right, or any other right of any third party.

If the submitted material contains third-party works (such as editorials, photographs) whose ownership is not with the Contributor, Contributors declare to have obtained all the necessary rights which permit the EUF to use the submitted material as specified above. The EUF has the right to request evidence of such permissions or licences to use third-party material and Contributors assume full responsibility for any damage or loss caused due to their violation of third-party rights.

By submitting information on the PhD Hub platform, you represent and warrant that (i) you have obtained written consent from any identifiable individuals aged 18 or above and/or from the minor’s parents/legal guardian if any minor is depicted in the

data submitted (or each component thereof); (ii) your information will not give rise to any claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party, or give rise to any claims whatsoever, nor violate any applicable law or regulation. It is the Contributor’s responsibility to ensure that the necessary consent has been obtained. In the event that Contributors submit material for which they do not have the appropriate permissions, they accept liability for any and all resulting consequences.

-OUR POLICY REGARDING CHILDREN

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to use our Services. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 13 may provide any personal information. In the event that we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under the age of 13, please contact us at contact@phdhub.eu.

-CONSENT TO COMMUNICATION

We may contact you at the email address you provided in order to request more information about the data you submitted upon the registration of the account to ensure that the validation procedure is in line with the highest security standards.

-LEGAL COMPLIANCE AND GOVERNING LAW

Any controversy concerning these Terms and Conditions shall be governed by the law of the European Union, complemented where necessary by the substantive laws of Luxembourg. In case any dispute, controversy or claim arising out of or relating to the subject matter hereof cannot be settled amicably between the Contributors and EUF, it shall be submitted to the exclusive jurisdiction of the courts of Luxembourg.

GLOSSARY

Account – The central means of access to the non-public parts of PhD Hub Platform and for using the services, which include User’s profile. It is used to identify the User and provide a set of administrative tools.

Academic Staff Member – One or more natural persons at a HEI, authorised by the local PhD Hub Coordinator, able to perform number of administrative tasks on the Platform.

Enterprise/Institution – Business entities registered and approved by the local PhD Hub coordinator on the PhD Hub Platform to cooperate with HEIs and PhD Students for research and development in their respective economic areas.

HEI – Higher Education Institution

PhD Hub Coordinator – Responsible person at a HEI with administrative power to create accounts for other staff members and PhD students, and invite Enterprises/Institutions.

PhD Student – Student enrolled in a PhD programme at a HEI.

Platform – PhD Hub Website and its interrelated services.

Services – Any services provided or made available by the Provider via the PhD Hub platform as well as relevant interconnected tools or relating thereto.

User – PhD Hub coordinator, academic staff member, contact at the Enterprise/Institution, PhD Student, PhD seeking student. A user is also known as Contributor.
